General conditions
The driver must hold a valide driver's licence and identity card/passport. The driver should provide all the requested information to the renter
MINIMUM AGE IN Romania is 21. Driver has to be in possession of a valide driving licence for at least 1 year.
The rental minimum period is 3 days.
SmartCars obligations
We shall supply the vehicle in a safe and roadworthy condition.
We shall be responsible for all ordinary and extraordinary costs of running the vehicle during the term of hire except to the extent that those costs are payable by yourself.
"Note: By virtue of clause above, the cost of petrol and other fuel, but not oil, used during the term of the hire is the responsibility of you."
Age restrictions and who can drive the car
A. You represent that you are a capable and validly licensed driver. You agree that we have the right to verify that your license has been validly issued and is in good standing; and that we may refuse to rent to you if your license has been suspended, revoked, otherwise restricted in any way, or if your driving record is unsatisfactory to us.
B. We reserve the right to deny rentals based upon information about your license status or driving record provided by the Motor Vehicle Department of the jurisdiction that issued your license.
C. Except where otherwise specifically authorized by applicable law, only you, your spouse or domestic partner, or, if you rent from us under your employer's corporate account agreement, your employer or a regular fellow employee incidental to business duties may drive the car, but only with your prior permission. The other driver must be at least 21 years old and must be a capable and validly licensed driver. As the renter or signatory of this Agreement, you certify that you hold a valid driver's license for the appropriate class authorizing you to drive the vehicle or vehicles described in the contract and you undertake to ensure that any person called upon to drive the said vehicle or vehicles also holds a valid driver's license for the appropriate class.
Return of the Car
- You agree to return the car to us in the same condition you received it, ordinary wear and tear excepted, on the due date and at the time and to the location specified by you at the time of reservation.
- If you return it later, a penalty fee will apply such as : First hour delay is free of charge. The next 3 hours are charged at 10 EUR/hour. Over 4 hours delay one day will be charged.
In any case you have to inform the SmartCars representative about your delay with at list 2 hours in advance .
- You may not return the car at a time when we are closed, in a different place than initaly specified without a previouce notice to our representative.
- If you wish to extend any rental you must contact our representatiuve at list 24h in advance and to request this option. We might not be able to extend the liese , but we will do our best to find the best suitable solution for you.
Reservation
You agree that you must make a reservation for each rental at least 24 hours prior to the scheduled time of rental . In case you need a car just on spot please use the RESERVATION CENTER phones : +4.0723.667.309
Rental Charges and Conditions
The client shall pay for his disposal vehicle a sum of money, EURO, USD, OR LEI/RON equivalent according to the BNR exchange rate of the day. The payment can be cash or be done using credit card (MASTERCARD, EUROCARD, VISA).
A deposit is required for every car and has to be paid in cash upon pick up.
The rates include maintenance, oil, unlimited mileage, collision damage wiver (CDW), theft protection (TP) and exclude fuel and flat tires.
General insurance conditions
Collision Damage Weiver (CDW) removes the driver's responsibility to a part of the vehicle in case of damage.
Theft protection (TP) removes the driver's responsibility to a part of the vehicle in case of theft.The client undertakes to report to the nearest police the unfortunate event of an accident and an damage report obtained. Without this report the driver could be responsible for the total cost of repairs. With this report the driver responsibility is limited to the amount of deposit.For negligent or drunk driving, driving under influence of drugs or alcohols or driving on unauthorized roads, obvious acts of disregards to the vehicle, driving the car by an unauthorized persons, the rental will be responsible to the full amount of repairs.
Damage to/Loss of the Car
If you do not accept CDW, or if the car is lost or damaged, you are responsible and will pay us for all loss of or damage to the car regardless of cause, or who, or what caused it. If the car is damaged, you will pay our estimated repair cost, or if, in our sole discretion, we determine to sell the car in its damaged condition, you will pay the difference between the car's retail fair market value before it was damaged and the sale proceeds. If the car is stolen and not recovered you will pay us the car's fair market value before it was stolen.
As part of our loss, you'll also pay for loss of use of the car, without regard to our fleet utilization, plus an administrative fee, plus towing and storage charges, if any ("Incidental Loss"). On our request, you will provide us with the name of your insurer and policy number, or if the insurance is provided by your card issuer, its insurer. You authorize us to process any or all of our Incidental Loss to the card you use to pay for the rental. You also authorize us to collect any or all or of our loss from any third party that is responsible for it. If we collect our loss from a third party after we have collected our loss from you, we will refund the difference, if any, between what you paid and what we collected from the third party. If the law of a jurisdiction covering this rental requires conditions on CDW that are different than the terms of this agreement, such as if your liability for ordinary negligence is limited by such law, that law prevails. You understand that you are not authorized to repair or have the car repaired without our express prior written consent. If you repair or have the car repaired without our consent, you will pay the estimated cost to restore the car to the condition it was in prior to your rental. If we authorize you to have the car repaired, we will reimburse you for those repairs only if you give us the repair receipt.
Repairs and alterations
- You will not permit any repair to be made to the Vehicle, or the replacement of any part on the Vehicle, without the prior consent of SmartCars.
- You will not tamper with the Vehicles odometer or speedometer or otherwise alter the Vehicle.
- You will pay for all unauthorized repairs and replacement parts, as well as the cost of restoring any unauthorized alterations.
Maintenance, Security and Safety
You and any Authorized Driver must:
A. maintain all of the Vehicles engine oils and engine coolant levels to the manufacturers specifications as set out in the Vehicles operations manual located in the glove box;
B. keep the Vehicle locked and the keys under Your or the Authorized Drivers personal control at all times; and
C. comply with any applicable seat belt and child restraint laws.
You must not have repairs to the Vehicle carried out unless SmartCars authorizes You to do so.
SmartCars requires verification of the cost of repairs for audit purposes. You should obtain an original tax invoice/receipt to assist SmartCars. We will reimburse You for any repairs to the Vehicle authorized by it, provided that the cost of those repairs is verified. To the extent that SmartCars cannot verify the cost of repairs,we will not reimburse You.
Use of the Vehicle
You and any Authorized Driver must:
A. not allow the Vehicle to be used for any illegal purpose, race, stunt, contest or performance test of any kind;
B. not allow the Vehicle to be used to tow or push anything unless authorized by SmartCars;
C. not carry more passengers than may be properly accommodated by the seat belt restraints provided in the Vehicle, or carry a greater load than that for which it was built;
D. not operate the Vehicle under the influence of alcohol, drugs or any substance including prescribed medicines that impairs driving ability or refuse to perform any test of impairment when lawfully requested to do so as evidence of such impairment;
E. when leaving the vehicle, remove the keys, close and lock all doors, windows and truck and take care all reasonable care to minimize the risk of vandalism or theft of the Vehicle;
F. use the Vehicle to perform a felony or criminal offence or for the transportation of illegal substances or contraband;
G. not allow the Vehicle to be used to carry passengers or property for payment of any kind;
H. not use the Vehicle when it is damaged or unsafe;
I. not use the Vehicle to transport goods, except in compliance with all necessary approvals, permits, licenses and government requirements (to be obtained at Your cost) and in accordance with the Vehicle manufacturers and SmartCars recommendations;
J. not use the Vehicle for the conveyance or towing of any load which is incorrectly loaded or secured or is in excess of that for which the Vehicle was constructed;
K. not, without SmartCars prior written consent, use the Vehicle to carry any flammable substance or any other explosive or corrosive substances;
L. not use the Vehicle in a reckless manner or in contravention of any law.
Delivery/Collection
Delivery/Collection is free of charge in the Bucharest city limits, Bucharest Baneasa Airport and Otopeni Airport . Outside city limits EUR 0,30/km will be charged.
Brakes of traffic laws
Any parking tickets or traffic violations are the responsibility of the renter.
Crossing border
Cross border rentals are not allowed.
Fuel services Options

If you aren't sure how far you'll be driving, but plan to stop for gas, don't accept the Fuel Service Option. Simply bring the car back full, provide a receipt for your gas purchase, and you’ll avoid any refueling service charge.
o or leave it to us !
Pay in advance for a full tank of fuel and bring the car back empty. Our rates for this option are comparable to the current local retail pump price, and you should bring the car back as close to empty as possible, because no credit will be given for unused fuel.
Immediate Return of Vehicle Where Default or Damage
SmartCars has the right to terminate the hiring and take immediate possession of the vehicle if the customer faisl to comply with any of the Terms of the Rental Agreement or if the vehicle is damaged. The termination of the hiring under the authority of this clause shall be without prejudice to the other rights of ourst and the rights of you under the Rental Agreement or otherwise.
